Terms of service

Last updated: October 13, 2026

Welcome to Tatova Hata Canada. These Terms of Service ("Terms") govern your use of the Tatova Hata Canada website, online store, and related information, content, features, tools, products, and services (collectively, the "Services") operated by Tatova Hata Canada Ltd. ("Tatova Hata Canada", "we", "us", or "our").

Tatova Hata Canada is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms carefully, as they contain important information about your rights and responsibilities, including provisions concerning warranties, liability, intellectual property, and dispute resolution.

By visiting, interacting with, accessing, or using the Services, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access the Services.

1. Access and Account

By using the Services, you represent that you are at least the age of majority in your state, province, territory, or other jurisdiction of residence, or otherwise have the legal capacity or authorization required to use the Services and enter into a purchase agreement.

To use the Services, including browsing our online store, creating an account, or purchasing products or services, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping information.

You represent and warrant that the information you provide is accurate, current, and complete and that you have all rights necessary to provide that information.

You are solely responsible for maintaining the security and confidentiality of your account credentials and for activity conducted through your account.

You may not transfer, sell, assign, or license your account to another person.

To delete your account or request erasure of your personal data, contact support@tatovahata.com.

2. Our Products and Handcrafted Variations

Tatova Hata Canada offers handcrafted decorative products, gifts, and related products and services, with a particular focus on handcrafted glass.

Many Tatova Hata Canada products are individually handcrafted and may be mouth-blown, form-pressed, hand-finished, hand-painted, or made using a combination of these techniques. Small variations between individual pieces may naturally occur.

Variations in color, brushwork, finish, shape, dimensions, decorative details, or other handcrafted characteristics are not necessarily defects and may form part of the individual character of the product.

Where a product page indicates that the color palette may vary, the product received may have a different color palette from the one shown.

Product descriptions, specifications, availability, and other information may be updated from time to time. We reserve the right to discontinue products, change availability, or limit quantities offered to any person, geographic region, or jurisdiction where reasonably necessary and subject to applicable law.

3. Orders

When you place an order, you are making an offer to purchase the products or services included in that order.

Tatova Hata Canada reserves the right to accept, decline, or cancel an order where reasonably necessary, including because of inventory shortages, pricing or listing errors, payment problems, suspected fraud, shipping restrictions, or other legitimate operational or legal reasons.

Your order is not accepted until we confirm acceptance or begin fulfilling the order. Payment must be successfully authorized or processed before fulfillment.

Please review your order carefully before submitting it. Once an order has entered processing or fulfillment, we may be unable to accommodate cancellation or modification requests.

If we decline or cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.

If we need to decline, materially modify, or cancel an order, we will make reasonable efforts to notify you using the email address, billing information, shipping information, and/or telephone number provided with the order.

Retail purchases are generally intended for personal or household use and not for unauthorized commercial resale. This restriction does not apply to wholesale, custom, bulk, corporate, or other B2B purchases expressly arranged with Tatova Hata Canada.

4. Prices, Taxes, Duties and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price applicable when your order is placed, subject to correction of genuine errors as permitted by applicable law.

Applicable taxes, shipping charges, handling charges, and other applicable charges will be displayed during checkout before you complete your purchase.

Where applicable, duties and import charges are included in the amount shown at checkout unless otherwise stated during checkout.

Prices available through our online store may differ from prices offered at markets, events, physical retail locations, wholesale channels, or other sales channels.

We may offer promotions from time to time that are subject to separate promotional terms. If specific promotional terms conflict with these Terms, the specific promotional terms will govern that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information for purchases made through the Services and to promptly update information where necessary so that we can complete your transactions and contact you.

You represent and warrant that:

  • the payment information you provide is true, accurate, and complete;
  • you are duly authorized to use the payment method submitted;
  • charges incurred using that payment method will be honoured by the applicable financial institution or payment provider; and
  • you will pay all amounts properly charged in connection with your order, including applicable taxes, shipping, and handling charges.

5. Shipping and Delivery

Shipping rates, dispatch, delivery estimates, tracking, signature requirements, duties, undeliverable shipments, and related shipping matters are governed by our Shipping Policy.

We aim to prepare and hand orders to the courier on the same or next business day whenever possible. This is a service goal and is not a guaranteed dispatch time.

Delivery times provided by couriers or displayed during checkout are estimates only and are not guaranteed by Tatova Hata Canada.

Delivery may be affected by weather, transportation disruptions, seasonal shipping volumes, customs processing, courier operations, or other circumstances outside our reasonable control.

Damage occurring during delivery should be reported in accordance with our Return & Refund Policy.

6. Returns, Refunds and Damaged Products

Returns, refunds, exchanges, damaged shipments, return shipping costs, return packaging requirements, final-sale products, and related matters are governed by our Return & Refund Policy.

Our standard return-request period is 14 days from delivery, subject to the conditions and exclusions stated in that policy and applicable law.

7. Sale Items and Gift Cards

Sale items are final sale and cannot be returned or exchanged except where required by applicable law.

Gift cards are non-refundable and cannot be redeemed for cash except where required by applicable law.

8. Custom, Wholesale and B2B Orders

Tatova Hata Canada may provide custom production, personalized products, wholesale orders, bulk orders, corporate gifting, branded products, location-specific designs, commemorative pieces, exclusive collections, and other business-to-business services.

Custom-made, personalized, wholesale, bulk, and other B2B orders are final sale and cannot be returned, refunded, or exchanged except where required by applicable law or expressly agreed otherwise in writing.

Unless different terms are stated in an accepted quotation, invoice, purchase agreement, or other written agreement, custom and B2B orders require a 50% advance payment.

The advance payment is non-refundable once paid, except where required by applicable law.

A custom or B2B quotation, invoice, purchase order, or agreement may contain additional terms concerning product specifications, artwork, approvals, quantities, production tolerances, lead times, payment schedules, shipping, delivery, cancellation, acceptance, intellectual property, or other matters.

Where specific written terms applicable to a custom or B2B order conflict with these general Terms, the specific terms applicable to that order will govern to the extent of the conflict.

Unless otherwise agreed in writing, Tatova Hata Canada reserves the right to photograph, reproduce, display, and reference custom products, designs, and completed projects for bona fide portfolio, case study, sales presentation, business development, and marketing purposes.

A client may withdraw such permission for future use by written notice to Tatova Hata Canada. Any such withdrawal will apply prospectively and will not require the removal, recall, or destruction of materials already produced or distributed before receipt of the notice, except where otherwise agreed in writing.

Tatova Hata Canada will not disclose a client's non-public contact information or facilitate direct contact between a prospective client and an existing or former client without that client's prior consent.

9. Intellectual Property

The Services and their contents, including but not limited to trademarks, trade names, logos, branding, text, photographs, displays, artwork, illustrations, graphics, product designs, decorative patterns, packaging designs, videos, audio, collection names, and the design, selection, and arrangement of such materials, are owned by or licensed to Tatova Hata Canada, our affiliates, artists, suppliers, or licensors as applicable.

These materials may be protected by Canadian, USA, and other applicable copyright, trademark, industrial design, patent, and intellectual property laws.

These Terms permit you to use the Services for lawful personal and non-commercial purposes only unless otherwise expressly authorized by us.

You may not reproduce, duplicate, copy, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download for commercial purposes, sell, resell, store for commercial exploitation, transmit, or otherwise commercially exploit protected materials from the Services without our prior written authorization, except where applicable law expressly permits such use.

Purchasing a Tatova Hata Canada product does not transfer any intellectual property rights in the design, artwork, decorative elements, packaging, branding, or other protected elements of that product.

You may not copy, reproduce, imitate, manufacture, commission, or commercially exploit Tatova Hata Canada product designs, artwork, decorative patterns, packaging designs, or other original creative elements without our prior written authorization.

Nothing in these Terms grants or shall be construed as granting any licence or other rights under any trademark, copyright, industrial design, patent, or other intellectual property right of Tatova Hata Canada, Shopify, or any third party except as expressly stated.

Tatova Hata Canada names, logos, product and service names, designs, and slogans may constitute trademarks or other proprietary rights of Tatova Hata Canada or its affiliates or licensors and may not be used without appropriate authorization.

Shopify's name, logos, product and service names, designs, and slogans are trademarks of Shopify. Other names, logos, product and service names, designs, and slogans appearing through the Services may be trademarks of their respective owners.

All rights not expressly granted are reserved.

10. Optional Tools

You may be provided with access to tools or functionality offered by third parties as part of the Services that we may not monitor, control, or have input into.

Such third-party tools may be provided "as is" and "as available" without representations, warranties, or endorsement by Tatova Hata Canada, subject to any rights that cannot legally be excluded.

Your use of optional third-party tools is at your own discretion and risk. You should review and understand any terms imposed by the relevant third-party provider before using those tools.

We may introduce new features, tools, or resources through the Services in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.

11. Third-Party Links and Services

The Services may contain materials, embedded functionality, or links to websites and services provided or operated by third parties.

We are not responsible for examining or evaluating the accuracy, content, availability, security, or practices of independently operated third-party websites or services.

If you choose to access a third-party website or purchase products or services directly from a third party, you do so subject to that third party's applicable terms and policies.

Questions or complaints concerning products or services supplied directly by a third party should be directed to that third party, except where Tatova Hata Canada has an independent responsibility under applicable law.

12. Relationship with Shopify

Tatova Hata Canada is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Tatova Hata Canada.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Tatova Hata Canada, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Tatova Hata Canada.

13. Privacy

All personal information we collect through the Services is subject to our Privacy Policy.

Certain personal information may also be processed by Shopify. You can learn more in Shopify's Privacy Policy.

Because the Services are hosted and supported by Shopify, Shopify collects and processes certain information about your access to and use of the Services in order to provide and improve the Services.

Information submitted through the Services may be transmitted to and processed by Shopify and other service providers that may be located in countries other than the country in which you reside. Please review our Privacy Policy for additional information about how personal information is collected, used, disclosed, stored, and transferred.

16. Feedback, Reviews and Submitted Content

If you submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, reviews, photographs, testimonials, proposals, plans, comments, or other content (collectively, "Feedback"), you grant Tatova Hata Canada a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, adapt, publish, distribute, and display that Feedback in any medium for purposes including operating, providing, evaluating, improving, and promoting the Services and our business.

You represent and warrant that:

  • you own or have all necessary rights to the Feedback you provide;
  • your Feedback does not violate the intellectual property, privacy, personality, or other rights of any third party;
  • you have disclosed any compensation or incentive received in connection with the Feedback where disclosure is required; and
  • your Feedback complies with these Terms and applicable law.

Unless otherwise agreed in writing, we are under no obligation to maintain Feedback in confidence, pay compensation for Feedback, or respond to Feedback.

We may, but are not obligated to, monitor, edit, or remove Feedback that we reasonably believe is fraudulent, unlawful, abusive, threatening, defamatory, obscene, misleading, infringing, or otherwise inappropriate or in violation of these Terms.

You may not use a false identity or email address, impersonate another person, or otherwise mislead us or third parties regarding the origin of Feedback.

You are responsible for the Feedback you submit and its accuracy.

17. Errors, Inaccuracies and Omissions

Occasionally, information on or through the Services may contain typographical errors, inaccuracies, or omissions relating to matters including product descriptions, pricing, promotions, offers, availability, shipping charges, or transit times.

We reserve the right to correct genuine errors, inaccuracies, or omissions, update information, or cancel an affected order where reasonably necessary, including after an order has been submitted, subject to applicable law.

18. Prohibited Uses

You may access and use the Services for lawful purposes only.

You may not access or use the Services, directly or indirectly:

  • for any unlawful, fraudulent, or malicious purpose;
  • to violate any applicable international, federal, provincial, territorial, state, or local law or regulation;

  • to harass, abuse, threaten, defame, intimidate, or harm another person;
  • to transmit false, fraudulent, or materially misleading information;
  • to send spam, junk mail, chain letters, phishing communications, or other unauthorized solicitations;
  • to impersonate or attempt to impersonate another person or entity;
  • to upload or transmit viruses, malicious code, malware, or other harmful technology;
  • to collect or track personal information about others without authorization;
  • to reproduce, extract, sell, resell, or exploit portions of the Services in violation of these Terms;
  • to interfere with or disrupt the operation or security of the Services;
  • to bypass or circumvent security, authorization, robot-exclusion, access-control, or anti-abuse measures; or
  • to engage in conduct that materially restricts or interferes with another person's use of the Services or exposes Tatova Hata Canada, Shopify, or users of the Services to material harm or liability.

We reserve the right to suspend, disable, restrict, or terminate access to the Services where we reasonably determine that these Terms have been violated or where continued access creates a material security, fraud, legal, or operational risk.

19. Automated Agents

This section applies if you use, allow, enable, or cause automated or semi-automated software or services, including bots, crawlers, scraping tools, AI agents, or similar systems (collectively, "Agents"), to access, use, or interact with the Services.

An Agent may not conceal or misrepresent its automated nature, circumvent CAPTCHAs or other measures intended to distinguish automated activity from human activity, bypass access restrictions, or continue accessing the Services after we have instructed or technically required the Agent to stop.

We may use technical measures to limit or control whether and how Agents access, use, or interact with the Services.

Where technically applicable, Agents must accurately identify themselves in their requests and must not deliberately disguise automated activity as human activity.

20. Termination

We may suspend or terminate this agreement or your access to all or part of the Services where reasonably necessary, including because of a violation of these Terms, suspected fraud or misuse, security concerns, legal requirements, or material operational risk.

You remain responsible for amounts properly due up to and including the date of termination.

Provisions that by their nature should continue after termination will survive termination, including provisions relating to Intellectual Property, Feedback, Privacy, amounts owing, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, and Governing Law.

21. Disclaimer of Warranties

Information presented on or through the Services is provided for general information purposes. While we make reasonable efforts to maintain accurate information, we do not guarantee that all information will at all times be complete, current, or error-free.

To the fullest extent permitted by applicable law, and except as expressly stated by Tatova Hata Canada, the website and online Services are provided on an "as is" and "as available" basis without representations, warranties, or conditions of any kind, whether express or implied.

We do not guarantee that access to the Services will always be uninterrupted, timely, secure, or error-free.

Nothing in these Terms excludes, restricts, or modifies any warranty, condition, consumer guarantee, statutory right, or remedy that cannot legally be excluded, restricted, or modified.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Tatova Hata Canada Ltd., its affiliates, partners, directors, officers, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar losses arising from or relating to your use of the Services or products purchased through the Services.

This limitation applies regardless of whether a claim arises in contract, tort, negligence, strict liability, or another legal theory, to the fullest extent permitted by applicable law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

23. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Tatova Hata Canada Ltd., Shopify, and our respective affiliates, partners, directors, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal costs arising from:

  • your material breach of these Terms or policies incorporated into them;
  • your violation of applicable law;
  • your infringement or violation of another person's rights; or
  • your unlawful or unauthorized use of the Services.

We may reasonably control the defence and settlement of an indemnifiable claim, and you agree to cooperate by providing relevant information and documentation.

24. Severability

If any provision of these Terms is determined to be unlawful, invalid, void, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law or severed where necessary.

The determination will not affect the validity or enforceability of the remaining provisions.

25. Waiver and Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with our policies and any other terms or agreements expressly incorporated by reference, constitute the agreement governing your use of the Services and supersede prior or contemporaneous agreements, communications, and proposals concerning the same subject matter, whether oral or written.

For custom, wholesale, bulk, or B2B transactions, an accepted quotation, invoice, purchase agreement, or other written agreement may supplement or modify these Terms as expressly provided in that document.

26. Assignment

You may not delegate, transfer, or assign these Terms or your rights or obligations under them without our prior written consent, and any unauthorized attempt to do so may be void.

We may transfer, assign, or delegate our rights and obligations under these Terms in connection with a corporate reorganization, merger, acquisition, sale or transfer of the business or its assets, or similar transaction, subject to applicable law.

27. Governing Law and Jurisdiction

These Terms and any dispute arising from or relating to the Services, an order, or a purchase from Tatova Hata Canada are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Subject to any jurisdictional or consumer protection rights that cannot legally be waived, disputes will be subject to the jurisdiction of the courts of Ontario.

28. Headings

The headings used in these Terms are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

29. Changes to These Terms

You may review the current version of these Terms at any time on this page.

We may update, change, or replace portions of these Terms from time to time to reflect changes to our business, Services, policies, or legal requirements.

The current version will be published on this page together with the date of the latest update. Where required by applicable law, we will provide appropriate notice of material changes.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by applicable law.
